SUMMARY:Zur Krise des Völkerrechts
DESCRIPTION:Vortrag von Prof. Dr. Matthias Goldmann\, LL.M. (NYU) zum Thema ‚Zur Krise des Völkerrechts‘ im Hörsaalzentrum Saal 13\, Campus Westend der Goethe-Universität Frankfurt \n  \nZum Vortrag\nDie nach 1990 weit verbreitete Hoffnung auf ein konstitutionelles Völkerrecht zerbricht dieser Tage angesichts vielfacher\, kaum verhohlener Völkerrechtsbrüche. Trotz einer Rekordzahl an Verfahren droht der Internationale Gerichtshof an Bedeutung zu verlieren. Dies ist jedoch nicht überraschend\, denn das Völkerrecht ist immer ein Spiegel der internen Verhältnisse der beteiligten Staaten. Die Zunahme autoritärer Regierungsformen musste die Völkerrechtsordnung beeinträchtigen und ist ursächlich für das Erstarken von Großmachtpolitik (erste These). Dies wirft die Frage nach der Zukunft Europas in der Völkerrechtsordnung auf. Da sich die Außenverhältnisse über analoge Mechanismen auch immer auf die interne Verfassungsordnung auswirken\, ist Großmachtpolitik oder auch nur ein „Mitschwimmen“ im Schlepptau von Großmächten für eine demokratische\, liberale Europäische Union keine Option (zweite These). Im Wege einer kritischen Rückschau auf die Völkerrechtsgeschichte legt der Vortrag dar\, dass ein hohes Niveau an sozialer und globaler Gleichheit eines der probatesten Mittel gegen Großmachtpolitik ist. Daraus konzipiert der Vortrag ein „Völkerrecht der Gleichen“ als Alternative zur Großmachtpolitik und diskutiert mögliche Akteure und\nInstrumente (dritte These). \n  \nZum Referenten\nProf. Dr. Matthias Goldmann\, LL.M. (NYU) hat in Würzburg und Fribourg (Schweiz) Rechtswissenschaften studiert. Er arbeitete am Internationalen Strafgerichtshof für Ruanda und erwarb im Anschluss an das zweite juristische Staatsexamen einen LL.M. an der New York University School of Law. Danach war er Wissenschaftlicher Referent am Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht in Heidelberg\, wo er an der Universität mit einer von Prof. Armin von Bogdandy betreuten Arbeit mit dem Titel „Internationale öffentliche Gewalt. Handlungsformen internationaler Institutionen im Zeitalter der Globalisierung“ promoviert wurde. Forschungsaufenthalte führten ihn u.a. an das Europäische Hochschulinstitut in Florenz\, an die University of Cambridge und an die London School of Economics. 2015 erhielt er ein Freigeist-Fellowship der Volkswagen Stiftung. 2016 bis 2021 war er Juniorprofessor an der Goethe-Universität in Frankfurt am Main. Ende 2021 hat Matthias Goldmann einen Ruf an die EBS Universität für Wirtschaft und Recht angenommen und ist seither dort Inhaber eines Lehrstuhls für Internationales Recht und im Nebenamt weiterhin Wissenschaftlicher Referent am MPI in Heidelberg. 2025 habilitierte er sich am Fachbereich Rechtswissenschaft der Goethe Universität mit einer Schrift mit dem Titel „The Constitution of Capital“ (im Erscheinen bei Oxford University Press). Matthias Goldmann hat zahlreiche Fachbeiträge veröffentlicht und war von 2017 bis 2022 einer der Schriftleiter des German Law Journal. Seine Forschungsschwerpunkte sind das Recht und die politische Ökonomie des Finanzwesens\, die Transformation der Wirtschaftsverfassung sowie die Theorie und Geschichte des Europa- und Völkerrechts\, insbesondere deren koloniale Vergangenheit. The evening will feature a panel discussion in which the speakers share insights into their careers and reflect on gender-specific challenges and opportunities in the workplace. \nModerator: \nMaria-Therese Bless \nMaria-Therese Bless is a lawyer at A&O Shearman\, specializing in German and EU financial regulation\, with a particular focus on the digital transformation of financial markets and crypto-assets regulation. She advises leading financial institutions and FinTechs on authorization\, conduct\, and compliance mattersand brings significant experience in complex cross-border regulatory and digital assets-relatedmatters. \nPanelists: \nAndrea van Almsick \nAndrea van Almsick is the General Cousel of tradias GmbH\, a leading company in digital asset and crypto trading. An accomplished professional in the financial sector\, Andrea van Almsick has built a strong international career in asset management\, serving as Head of Legal at Fidelity International and AXA Investment Managers. She is a former Board of Donors member of the ILF. \nMiao Lin \nMiao Lin is the managing director of ACT Applied Carbon Technology GmbH\, a company active in the wind energy sector. Alongside her executive role\, she oversees the company’s legal and compliance functions. Prior to joining ACT\, Miao Lin gained extensive experience in capital markets and M&A. She advised companies and investment banks on IPOs\, capital increases and bond offerings in Germany and Hong Kong. As M&A counsel\, she focused on cross-border transactions involving Chinese investors. In addition\, Miao Lin has a strong interest in international arbitration and served as a member of the China Committee of the German Arbitration Institute (DIS). To promote cooperation and dialogue between the German and Chinese arbitration communities\, she has helped organize and acted as a moderator at several high-profile joint arbitration events in Beijing\, Frankfurt\, and Berlin. She is an alumna of the ILF. \nDr. Ulrike Binder \nDr. Ulrike Binder is a Partner at Mayer Brown and heads Mayer Brown’s German Corporate Group. She is a transactional lawyer advising German and international clients on complex transactions with a special focus on the financial industry. She has extensive international experience working on cross-border transactions in international teams. She is a lecturer at the ILF. \nDr. Hildegard Bison \nDr. Hildegard Bison serves as Assistant General Counsel\, Customer & Products ESA and MOW Refining\, and is a Member of the Management Board at BP Europa SE. She brings extensive in-house legal and leadership experience within the energy sector\, advising on complex regulatory\, commercial\, and strategic matters across European and international markets. Before joining BP she has been an equity partner at Freshfields for more than a decade. \nDr. Gökçe Uzar Schüller \nDr. Gökçe Uzar Schüller is an Associated Partner and lawyer at GvW Graf von Westphalen. She advises companies on market entry and business operations in Turkey and heads the firm’s Turkey Desk. Dr. Uzar Schüller has extensive experience\, particularly in M&A transactions\, German-Turkish legal matters\, and cross-border transactions. Additionally\, she has a background as an arbitrator and serves as both an arbitrator and counsel in numerous international arbitration cases under the ICC (International Chamber of Commerce) and DIS (German Arbitration Institute).
